I have been told by many people that this pony has a really bad sway back but I think that the first ponys is much worse;

I have to agree that neither of these horses appear top have swaybacks. One could use a bit of feed and both look as if being ridden correctly would benefit them.
There is a difference between the conformation fault of swayback and the lack of top line.

To me..they both don't have too bad of sway back. They actually look quite normal. The first one is gorgeous!

I don't think either is particularly horribly sway backed, the second horse is slightly worse than the first
I don't think either pony has a sway back. The second rider was heavy and the pony relaxing. If you're not sure, get a vet check. Most sales require a vet check, and you should bring your prospective pony and your vet together before the purchase is final.
I remember seeing the other one before. The new picture is hard to tell because of the angle that the photo was taken at but neither are that bad. I've seen way worse. We had a weanling whose back was so bad that we named him Patrick Swayze. He was never broken because he could't wear a saddle and he was eventually given to a guy that worked with me and he turned him out with his cattle.
